Appeal against extending Metal Industries Main Agreement to non-parties unsuccessful.
The Labour Appeal Court dismisses NEASA and SAEFA’s attempt to stop the extension of the Metal and Engineering Industry extended to non-parties
On 30 November 2022 the Labour Appeal Court has dismissed NEASA’s and SAEFA’s petition for leave to appeal. The Court is of the view that the intended appeal had no reasonable prospects of success and that there is no compelling reason why it should be heard.
The Metal and Engineering Industries Main Agreement was extended to non-parties earlier this year. NEASA and SAEFA have attempted to have the application to extend the Main Agreement to non-parties stopped, as well as the actual extension. This has been unsuccessful.
